User Agreement

Permissible Purpose & Credit Report Authorization

By applying for a loan with Facila Capital, you provide written instructions under the Fair Credit Reporting Act (FCRA) authorizing us to:

  • Obtain and monitor your credit report and score(s) on a recurring basis.
  • Verify your identity and assess your creditworthiness.
  • Provide credit monitoring, tracking, and alerts for changes in your credit profile.
  • Share your information with Experian Information Solutions, Inc., Dun & Bradstreet, Inc., or other credit reporting agencies.
  • Offer you financial products and services from us or third parties. We may receive compensation for marketing such offers.

By submitting a loan application, you expressly consent to receiving SMS text notifications regarding credit monitoring and loan services.

Electronic Communications & Consent

Affirmative Consent

Since Facila Capital operates primarily online, you consent to receiving all notices, disclosures, and communications (“Communications”) electronically via email, Website postings, or other digital methods. This includes but is not limited to IRS Form 1099 notices.

You must maintain a valid email address and inform us of any updates. You may request a free paper copy of any communication by contacting us.

Withdrawing Consent

You may withdraw your consent for electronic communications by contacting us. However, withdrawal:

  • May result in termination of any pending loan applications.
  • Will not affect previous agreements or legally binding transactions.
  • Will take effect only for IRS Form 1099 communications for the current calendar year if requested before November 1.

To withdraw consent, email support@facilacapital.com with “Withdrawing Consent” in the subject line.

Hardware & Software Requirements

To access our electronic communications, you must have:

  • A device with an internet connection.
  • A supported web browser (Chrome 32+, Firefox 26+, Safari 7+, or Internet Explorer 8+).
  • PDF viewing software (e.g., Adobe Reader).
  • A valid email address.
  • A printer or the ability to save digital copies of communications.

If using a mobile device, ensure it supports document printing and saving.

Consent to Be Contacted

You expressly consent to be contacted by Facila Capital via:

  • Phone calls, including those using prerecorded messages, artificial voices, or automated dialing systems.
  • SMS/text messages, including marketing messages and loan-related notifications.

You agree that:

  • You are the owner or authorized user of any phone number provided.
  • Message and data rates from your carrier may apply.
  • Consent is not a condition of credit approval.

To opt out of SMS communications, reply “STOP” to any message or email team@facilacapital.com with “Opt Out” in the subject line.

Call Monitoring & Recording

Facila Capital may monitor and/or record calls for quality assurance, training, risk management, and compliance purposes.

Offers & Promotional Materials

Facila Capital may offer discounts, promotions, or special rates (“Promotions”). Unless stated otherwise:

  • Promotions are non-transferable.
  • Unauthorized reproduction or distribution is prohibited.
